FIMA Constitution
Article 1: PREAMBLE In
1981, a group of Muslim Physicians and health care professionals from
Canada and United State of America, India, Pakistan, Indonesia, Jordan,
South Africa, Sudan, Nigeria, United Kingdom of Eire, met in Orlando,
Florida, USA. They Discussed the need for an organization to unite all
Islamic Health Care association in the World under one banner. Thus the
FEDERATION OF ISLAMIC MEDICAL ASSOCIATION (FIMA) was launched.
Believing that:
i) Islamic the universal religion, a blessing
to the man kind and a complete way of living with its own God ordained
laws, code of life and value system incorporating the Islam ethical and
moral code.
ii) The sovereignty over the entire universe belongs to Allah and that he is the source of all knowledge and truth.
iii) Allah has sent down the Holy Quran and His Prophet Mohammad (S.A. W.) as a guide in all our endeavors.
Thus
we who have been entrusted with the health care of His creation give
ourselves this constitution to use to seek His eternal pleasure.
ARTICLE II: NAME 2.1: The name of Organization shell be Federation Islamic Medical Association, hereinafter called (FIMA).
ARTICLE III: AIMS AND OBJECTIVE 3.1: To foster the unity and welfare of Muslim Medical professionals all over the world.
3.2:
To promote Islamic Medical activities including health services,
education and research, through cooperation and coordination among
member organization.
3.3: To promote the understanding the application of Islamic Principal in the field of Medicine.
3.4: To mobilize professional and economic resources in order to provide medical care and relief to affected areas and people.
3.5: To promote exchange of medical information and technical data among member organization.
ARTICLE IV: MEMBERSHIP: 4.1: CATEGORIES:
4.1.a: ORDINARY/FULL MEMBERSHIP: Any
bona fide Islamic Medical Association or organization of Muslim health
care personnel or founding Member good standing may become a member
provided that:
i) It subscribes to the preamble of FIMA constitution. ii) It agrees to abide by the aims and Objectives of FIMA. iii) It has a Constitution that agrees in the principle with FIMA constitution. iv) It holds elections and periodical meeting of its members. v) It publish an annual report. vi) It files an application from and the prescribed fees with the secretary General. vii) Its application is approved by the FIMA Council.
4.1.b: ASSOCIATE MEMBERSHIP Associate membership is offered to: i)
Any Muslim health care, education, research or welfare organization
which subscribes to the spirit of the preamble and the Aims and
objectives of FIMA. ii) Files an Application form and the prescribed fees with the Secretary General. iii) Its application is approved by the FIMA Council.
4.2: VOTING RIGHTS: i) Only full member of FIMA have the right to vote. ii) Each full member of FIMA has one vote.
4.3: SUBSCRIPTIONS: Subscriptions
shall be as determined by the council fromtfime to time. The annual
subscription shall be payable on or before the date of the annual
Council meeting and will be for the calender year only. Failure that to
pay the subscription for two (2) consecutive years will result in the
member organization ceasing to exercise any of rfight asa member,
including the power to vote. It, however, may still participate as an
observer.
ARTICLE V: ORGANIZATION STRUCTURE: 5.1: COUNCIL
5.1.a: The council shall be the highest policy making body of FIMA. 5.1.b:
Composition. One representative from each full member organization,
preferably the president. One representative from each associate
member, but with no voting right. 5.1.c: Duties. i) To assure that objectives of FIMA are being fulfilled. ii) To elect the Executive Committee and monitor its activities. iii) To appoint sub-Committees and monitor their activities. iv) To decide on dates and venues of Council meetings. v) To approve are reject new application for member ship. vi) To act as a Disciplinary Committee with powers to expel, suspended, fire or reprimand member organization or the executive. vii)
Is responsible for promoting idea of FIMA Internationally and encourage
formation of national bodies so as to enlarge the membership base of
FIMA. viii) Is responsible for all major financial decision and general funding of FIMA. ix)
To meet at least once a year to review the work of the Federation,
receive executive and sub-committee reports, and to approve annual
audited financial statement. x) It shall be the final arbitar in the interpretation of this constitution
5.2: EXECUTIVE COMMITTEE
5.2.a:
The Executive Committee shall be responsible for the implementation of
all Council decisions and for the general administration of the affairs
of FIMA.
5.2.b: Composition. a) President b) Vice president c) Secretary General d) Treasurer e) Three Committee member
5.1.c:Term of office. Two years. Each member shall be eligible for re-election.
5.2.d: Duties. i) To implement the Council decisions. ii) To present an annual report to the council outlining all its activities. iii) To keep book of account, open banking accounts and to present audited financial statements annually to the council iv) To take custody and control of all assets of FIMA. The assets of FIMA. v) Keep a roll of members. vi) Endeavour to keep a world directory of Muslims health organisations, Islamic medical schools, Islamic hospitals and clinics. vii) Publish bullets of FIMA.
5.3: MEETNGS : 5.3.a: Council and Executive Committee shall meet at least once a year .
5.4: QUORUM: 5.4.a: Quorum for meetings shall be at least 50% (fifty percent ) of full membership. 5.4.b:
All calls for Council meetings shall be made in writing at least two
months in advance, and at least 2/3 (two thirds) of full member
organisation must agree to attend in writing. Therefore, in the event
to attend in quorum, those full member organisations who are present
shall from the quorum.
5.5: MAJORITY: Decisions at all FIMA
meeting s ahall be jby a simple majority, except in event of lack of
quorum as stated in 5.4.b of article V. In such event the majority
shall be by 75% (seventy five percent ).
ARTICLE VI: GENERAL : 6.1: AMENDMENTS: 6.1.a:
Amendments to the Constitution may be proposed by the Executive
Committee, or the Council, or by a petition signed by at least three
full member organisation in good standing.
6.1.b: The proposed
amendments musty reach the secretary General at least two months before
the Annual Council Meeting, and it shall be circulated to the voting
members not less than thirty days prior to the Annual COUNCIL Meeting.
6.1.c:
The Constitution shall be amended during the Annual Council Meeting by
a two thirds majority of the total voting members who are in good
standing.
6.2: DISSOLUTION: 6.2.a: The decision to dissolve
FIMA can only be taken at a Council meeting by a 75% (seventy five
percent) majority of the total voting member who are in good standing .
6.2.b: In the event of dissolution the Council of FIMA, after
paying or making provision for payment of all liabilities, shall
distribute the remaining assets among existing member organisation in
good standing.
6.3: INDEMNITY: Every member of the Council
or, Executive Committee of the FIMA shall be and is hereby indemnified
against losses, expenses for damages incurred in the discharge of or
arising out of his duties; nor shall be for the acts, receipts,
neglects or defaults of any other member; unless the same happens
through his own dishonesty, in which case he shall be liable.
